These terms and conditions apply to the LA Design Furniture Properties and Products. Terms and conditions also apply to the LA Design Furniture website located www.sofa321.com , and all associated sites linked to www.sofa321.com. The site is the property of LA Design Furniture and its licensors. By purchasing and/or using LA Design Furniture’s website, you agree to the terms and conditions of LA Design Furniture. Terms & conditions are subject to change without prior notice.

Disclaimer: For all items, sizes and colors may vary. Measurements and materials are subject to change without prior notice. Although precautions were taken to optimize the catalog and website accuracy, errors or omissions are always a possibility. LA Design Furniture is not responsible for any errors or omissions, but, upon discovery of such, all reasonable steps will be taken to inform LA Design Furniture vendors and website updates. Screen resolutions are subject to individual settings. color, brightness, sizing and display are subject to variances. Thank you for your understanding.

Pricing and Payment

Prices for products listed on the Website are subject to change without notice. Payment is required at the time of purchase. We accept payment via most major credit cards, Apple Pay, Google Pay and other methods as specified on the Website. All payments are processed securely.

DELIVERY

Local delivery 50 miles from our warehouse located in Hacienda Heights, CA 91745. Delivery dates vary based on orders and appointments. Confirmations will be made in advance but are subject to change. For deliveries extending beyond a 50-mile radius, transportation will be managed by our esteemed freight partners.For detailed insights, please explore our FAQ section. For additional information, customer representatives at LA Design Furniture are available to assist you.

RETURNED MERCHANDISE:

No merchandise returns will be accepted without prior authorization and a return authorization number from LA Design Furniture. Any returns without an authorization will be refused by the warehouse. Pictures are required both before and after packaging, with the items being in their original package only.
We will gladly accept the return of any unopened, unused product in its original packaging, free from damage, within 30 days of the delivery date for a refund.
There will be a 20% restocking fee for returned items. Additionally, the actual shipping costs incurred will be deducted from the refund amount.
Claims for defective merchandise or missing parts must be made within 30 days of the delivery date.
Before signing the freight bill, please inspect all the boxes for damages and make sure the carrier has signed on the freight bill for any damages.
We DO NOT provide payment for RETURN SHIPPING except for order processing irregularities.
To initiate a claim for defective merchandise, pictures along with a copy of the invoice are required.

Customers are liable for the return shipping fees, except in cases of manufacturer defects or damage sustained during shipment.
Not all returns are accepted and each return request is subject to individual review on a case-by-case basis.

RECEIVING SHIPMENT

For shipments scheduled for delivery via freight, we advise conducting a thorough inspection of all boxes for any signs of damage or mishandling before signing the freight bill. It's essential to carefully examine each package to ensure that the contents are intact and undamaged. If any boxes show visible signs of damage, such as dents, tears, or punctures, it's crucial to note these discrepancies on the freight bill before signing. Additionally, make sure that the carrier acknowledges and signs off on any observed damages to the shipment. This documentation serves as crucial evidence in the event of a claim for compensation or replacement due to shipping-related issues. By adhering to these inspection procedures, we aim to ensure the safe and satisfactory delivery of your order.

REPLACEMENT PARTS:

Requests for replacements must include your original invoice. Please indicate which items and quantities are needed. All replacement parts or spare part orders are subject to LA Design Furniture’s Terms and Conditions of Sale.

LIMITED WARRANTY TERMS

LA Design Furniture warrants that its upholstered seating products are free from manufacturing defects and will either give credit or replace defective parts for a period of up to one (1) year from the date of purchase in accordance with the conditions set forth below. If a manufacturing defect is found, LA Design Furniture should be notified promptly of the defect and supplied a copy of the invoice and delivery ticket. Inspection by an LA Design Furniture employee or representative may be necessary to verify that a manufacturing defect exists, or you may be required to submit samples to LA Design Furniture along with a digital image of the defects. If replacement is required in accordance with this limited warranty and the defective material or merchandise has been discontinued or unavailable, LA Design Furniture reserves the right to select and supply a similar merchandise or offer full or partial credit for the merchandise in case by case basis; otherwise the same material or merchandise will be supplied for replacement purposes. Please see below for additional warranty terms for upholstery products. LA Design Furniture limited warranty terms are subject to change without prior notice.

ADDITIONAL CONDITIONS

The following examples are not manufacturer’s defects:

Colors may vary slightly from the photo because of photography and printing tolerances.
Foam will soften slightly.
Sizes are stated in U.S. standard measurements while the actual sizes are manufactured using the metric system therefore the sizes may vary slightly.
There are no exchanges or refunds on any pillows or toppers for mattresses sold.
No returns for buyer’s remorse.
Markings or dirt accumulated during manufacturing or transportation.

Warranty is void for any of the following conditions:

Improper maintenance or improper use resulting in damage.
Any product modifications/repair work consumer, or other parties not authorized by LA Design Furniture will void this warranty.
Floor samples sold, clearance products or products designated "AS IS" at the time of purchase are not covered by the warranty.
Assembled or disassembled products.
Items marked as non-returnable are not eligible for returns.
Warranty does not cover markings / stains/ dirt / discoloration after use or caused during transportation or relocation.
Warranty does not cover minor variations or differences between floor samples or printed illustrations and your furniture.
Cost of packaging and shipping to and from LA Design Furniture is not covered by the warranty unless expressly arranged by LA Design Furniture.
This warranty covers only articles of furniture intended for residential use only, does not cover any industrial, commercial, institutional, or rental use.
Dissatisfaction due to buyer’s remorse.
Fragile material such as Glass and Marble that is damaged after use.
Normal wear and tear.
Damages incurred during transportation.
Damages incurred during assembling or maintenance.
Damages incurred by accidents or abuse.

Warranty

LA Design warrants to the original consumer purchaser of this product based on reasonable use the following:

WARRANTY FOR TOP-GRAIN ITALIAN LEATHER, SKU(S) BEGINNING WITH "EK-":

1-YEAR LIMITED WARRANTY – SOFA CUSHIONING
LA Design warrants the cushions in its upholstered products to be free from abnormal loss of resiliency for a period of one (1) year.

The flattening of the fiber or foam materials used in cushioning that occurs due to normal use is considered a normal loss of resiliency. Normal loss of resiliency is not a defect in materials or workmanship and should not be confused with abnormal wear or abnormal loss of resiliency, and is not covered by this limited warranty.
1-YEAR LIMITED WARRANTY – SOFA LEATHER AND STITCHING
LA Design warrants the leather used to be free from tearing and splitting under normal use for a period of one (1) year from the date of purchase to the retail consumer. LA Design also warrants the stitching in its upholstered products to be free from defects in materials and workmanship for a period of one (1) year.

The inherent beauty of leather is due to variations in grain, texture, color tones, and its natural characteristics which contribute to the uniqueness of each upholstered leather product. Because leather is a natural product, this limited warranty does not cover natural characteristics of leather, such as markings caused by insect bites, barbed wire, veining, abrasions, injuries to the animal, wrinkling, or variations in grain or color tones on different sections of the same leather product. This warranty also does not cover normal wearing, durability and color fastness of leather. This warranty also does not cover mistreatment of the product, stripping, color fading, and discoloration due to chemical applications, accidental or malicious staining or vandalism. Using any after-market leather treatment on the leather will void the leather warranty of this product.
1-YEAR LIMITED WARRANTY – MECHANISMS
LA Design warrants the metal mechanisms in its upholstered products to be free from defects in materials and workmanship for a period of one (1) year.

WARRANTY FOR FAUX LEATHER, BONDED LEATHER, MICROFIBER LEATHER, GENUINE LEATHER, AND FABRIC SOFAS, SKU(S) BEGINNING WITH "AE-":

6 MONTHS LIMITED WARRANTY – SOFA STITCHING
LA Design also warrants the stitching in its upholstered products to be free from defects in materials and workmanship for a period of six (6) months.
6 MONTHS LIMITED WARRANTY – MECHANISMS
LA Design warrants the metal mechanisms in its upholstered products to be free from defects in materials and workmanship for a period of six (6) months.
LEATHERS & FABRICS: FAUX LEATHER, BONDED LEATHER, MICROFIBER LEATHER, GENUINE LEATHER, AND FABRIC(S) SOFAS
The Limited Warranties on “B” Grade leather, Upholstered Fabric, and Bonded & Man-Made leather or finishes and all other furniture products are not covered by LA Design. Any service(s) requests for these materials will be treated case by case at LA Designs discretion.

NO WARRANTY FOR FRAGILE PARTS OF ALL FURNITURE, SUCH AS BUT NOT LIMITED TO MARBLE AND GLASS.

LIMITED WARRANTY EXCLUSIONS AND CLARIFICATIONS

These warranties are extended by LA Design only to you, the original consumer purchaser at retail, and to no other person. This limited warranty is not transferable.

This limited warranty does not apply to any LA Design upholstered products used for any commercial, contract, institutional, rental-trade, or other non-household use. Limited Life-time warranty does not apply to cover damages incurred during the transportation of the product. Does not apply to damage resulting from misuse, abuse, neglect, cuts and scratches, accident, burns, fire, water or other hazard, shipment after original delivery to original retail purchaser, exposure to direct sunlight or bright lights or extreme heat or similar conditions resulting in discoloration, cracking or peeling of leather coverings. This limited warranty does not cover mistreatment of the product due to stripping, color fading, and discoloration due to chemical applications, accidental or malicious staining or vandalism. Limited Life-time warranty does not apply to floor samples or to sales made on an "as-is" basis.

LIMITATIONS AND EXCLUSIONS

Although LA Design stands by its Limited Warranty, there are some limitations and exclusions.

If a LA Design upholstered product does not conform to these limited warranties, your sole and exclusive remedy is (i) repair of any defective product or repair of any part of any product determined to be defective; (ii) replacement of any defective product or replacement any part of any product determined to be defective; or (iii) refund of the original purchase price paid by you for the defective product upon return to LA Design of the defective product. LA Design will pay the cost of labor to repair or replace defective parts.

ALL IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED TO THE DURATION OF THE EXPRESS LIMITED WARRANTIES SET FORTH FOR THE LA DESIGN UPHOLSTERED PRODUCT FRAMES, CUSHIONING, LEATHER AND STITCHING, MECHANISMS, AND SOFA BED PARTS SET FORTH IN THIS LIMITED WARRANTY.

No other express warranty has been made or will be made on behalf of LA Design Furniture, with respect to the furniture and its parts, or the operation, repair, or replacement of the furniture and its parts. Furthermore, No Representative of LA Design Furniture or its Distributors or Retailers is authorized to make any changes or modifications to these limited warranties.

Any work done to the product without approval from LA Design Furniture voids all warranty(s).

In the event shall LA Design Furniture be responsible for consequential or incidental damages, such as, loss of use, inconvenience, loss or damage to personal property, whether direct or indirect, and whether arising in contract or tort. In no event shall LA Design Furniture’s responsibility exceed the purchase price of the product of its replacement.

The limited warranties and remedies are exclusive and are in lieu of all other warranties and remedies, verbal or written, express or implied. Some states do not allow an exclusion or limitation on how long an implied warranty lasts, so the above limitations may not apply to you.

If any material or parts used in any defective product is unavailable at the time of repair, if LA Design elects to repair the defective product, LA Design reserves the right to substitute materials or parts of equal quality and value as determined in the sole discretion of LA Design.

LA DESIGN SHALL IN NO EVENT BE RESPONSIBLE TO YOU FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF TIME, USAGE, OR MONEY AND IN NO EVENT SHALL THE RESPONSIBILITY OF LA DESIGN FOR ANY DEFECT EXCEED THE PURCHASE PRICE PAID BY YOU, THE ORIGINAL CONSUMER PURCHASER AT RETAIL, FOR THE PRODUCT. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

TO VALIDATE YOUR CLAIM UNDER THIS LIMITED WARRANTY

Claims should be directly initiated by the original consumer purchaser rather than through retail stores. To avail of these limited warranties, meticulous attention to the following steps is essential:

Submission of a written limited warranty claim form directly to LA Design Furniture is required. This should include the product identification number from your original sales receipt, accompanied by a copy of the dated proof of purchase.

Provide LA Design Furniture with three photographs is necessary:

A clear picture of the LA Design upholstered product.
A photo depicting the label attached to the dust cover beneath the product.
Image(s) clearly showcasing the claimed defect(s).

Any report from an independent technician evaluating the claimed defect(s) should be provided.

Limited warranty claims for defects visible upon receiving the product should be promptly submitted to LA Design Furniture within 48 hours of receipt.
It is imperative to promptly notify LA Design Furniture of any alleged defect upon discovery, ensuring that this notification occurs no later than seven (7) days after you should have discovered the alleged defect.

LA Design Furniture will not accept a limited warranty claim from an original consumer purchaser that fails to include all of the information requested above. Upon completion of the warranty claim review, LA Design will assess whether the claimed defect is covered by this limited warranty. Once a decision is reached, LA Design will promptly communicate its determination.

LA Design has the sole right to determine whether a claim is covered by this limited warranty. All determinations regarding claims will be made within 30 days from receipt by LA Design of the claim. If a claim is approved, LA Design will fulfill its limited obligations to repair or replace the product as set forth herein within a reasonable time period.

This warranty does not cover packaging, shipping or transportation costs to and from the manufacturer, retailer or other repair point as required by LA Design. These costs remain the responsibility of you, the original consumer purchaser.

This limited warranty gives you, the original retail purchaser, specific legal rights, and you may also have other rights which vary from state to state.

Intellectual Property Rights:

All content on the Website, including text, images, graphics, logos, and user-generated content, is the property of LA Design Furniture and is protected by copyright laws and other intellectual property rights. You may not use, reproduce, distribute, or modify any content from the Website without our prior written consent.

Limitation of Liability:

To the fullest extent permitted by law, LA Design Furniture and its affiliates, directors, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, lost data, or business interruption, arising out of or in connection with your use of the Website or the Service.

Indemnification:

You agree to indemnify and hold harmless LA Design Furniture and its affiliates, directors, officers, employees, agents, and licensors from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Website or the Service, your violation of these Terms, or your violation of any rights of any third party.

Governing Law and Dispute Resolution:

These Terms shall be governed by and construed in accordance with the laws of California. Any dispute arising out of or relating to these Terms, the Website, or the Service shall be resolved exclusively by the state or federal courts located in California.

Changes to Terms:

We reserve the right to update or modify these Terms at any time without prior notice. Any changes to these Terms will be effective immediately upon posting on the Website. Your continued use of the Website after the posting of revised Terms constitutes your acceptance of the changes.
